Here Alex is Microsoft(main author) , which gave a chinese factory (Alan) to manufacter and market its product. Even if u asked microsoft to sell you, it would forward u to the chinese factory.. .... rest u have already read above

Doesn't matter.. At the end microsoft keep being not responsible at all about the hardware issues as not involved or in any partnership with IBM. A producer who manage by himself production and sells is the only person liable for hardware issues.

The product was purchased because it was made according to the specifications/support from microsoft(Bphreaks) and had their name on it. The chinese factory was just doing a job work.
So in Legal terms opnion would differ;-)
