You can Jailbreak.
Please post Model of the iPhone and we can point you to the correct software.

If not activate with a sim of same carrier, eg AT&T then replace with origional sim card later on.

Okay. Also do you know what network the handset is currently locked to? If not, please try following this guide on how to Jailbreak the handset. This will bypass activation and allow you to access the menus. This will NOT unlock the phone for use with different networks.

Hi all, i have 3GS 3.1.3 bb 5.12.1 with latest boot
can somebody help me to activate it? a have NO original sim!!! can i activate it with software? i want activate it and jailbrake, i know at this time is impossible to unlock it.

Just as i said above mate, Spirit is your best option for jailbreak at this time.

spirit cant jailbreak not activated iphone :-(

your iphone must be activated by original simcard if your iphone not activated and in display is emergency call only then its not supported for jailbreaking.

as i told, my iphone 3GS is not activated and i have no original sim!!!

well, I downloaded the Spirit, as it is written on the forum, then affiliated iphone to the PC and when I pushed on jailbreak in Spirit the error popped up ….

Guys, i don't understand why its a big fuss, just to activate & jailbreak v3.1.3 with modem firmware 5.12 is a piece of cake. Most recent one was day before yesterday.
Use redsn0w. it will activate it & jailbreak it.
here is a guide:-

BTW i have done it more than 3 times, but only on 3g, not 3gs.
