can i activate my 3gs 3.13 modem 5.12 with any tool.

Mate , if you are using an original simcard just open itunes and wait for activate the iphone.
but in other case if you want to unlock this version read on forum bcs you cant do unlock at the moment .

if i dont have original simcard , what i must do?

Use Redsnow 9.3 to jailbreak. This will activate your phone, but you wont have network. At least you can have some use of your phone. Hopefully a unlock sollution will com soon. Aplle is releasing version 4.0 tomoroow. Maybe we will get a sollution short after that.
